Harmonised Habits Terms and Conditions Agreement
GROUND YOUR GROOVE LTD
1. Introduction
These Terms and Conditions ("Agreement") apply to all coaching services provided by GROUND YOUR GROOVE LTD ("Coach") to any individual or organisation ("Client") and constitute the contract for the service to be provided by the Coach for the Client. The term 'coaching' encompasses life coaching, personal coaching, personal development, and mentoring services. By engaging in the 'Harmonised Habits' 12-week 1:1 coaching program ("Program"), you agree to be bound by this Agreement.
2. Coaching Disclaimer
By participating in the Program, you acknowledge and agree that:
The coaching services you receive are not a substitute for professional mental health care or medical care and are not intended to diagnose, treat, or cure any mental health or medical conditions.
The Coach is not acting as a mental health counselor or a medical professional.
Coaching is not a substitute for counseling, psychotherapy, psychoanalysis, mental health care, or substance abuse treatment, and you will not use it in place of any form of therapy.
All comments and ideas offered by the Coach are solely for the purpose of aiding you in achieving your defined goals.
Results are not guaranteed, and you are fully responsible for your well-being during your coaching sessions and subsequently, including your choices and decisions.
3. Services Provided
The Program is designed to help individuals overcome health procrastination and prioritise their health through natural lifestyle habits and coaching methods. Services include:
Weekly one-on-one coaching sessions (in-person or virtual)
Customized action plans and resources
Email support between sessions
Access to relevant materials and tools
4. Client Responsibilities
To achieve the best results, the Client agrees to:
Attend all scheduled sessions promptly
Complete assigned tasks and exercises
Communicate openly and provide feedback
Inform the Coach of any concerns or issues
5. Fees and Payment
The current fees for the Program will be made clear at the time of booking. GROUND YOUR GROOVE LTD reserves the right to change these fees from time to time, on which occasion this will be clearly communicated to the Client. Any payments for sessions paid in advance are honoured even if prices have risen between the point of booking and the time of session.
6. Payment Terms
Fees can be paid online by debit or credit card, using the “Stripe” payments gateway linked to the “ConvertKit” platform.
Receipts and/or invoices are available, and where receipts are requested by the client, they will be sent by e-mail.
Fees are payable in advance of the first coaching session of the Program. Where payment has not been received by GROUND YOUR GROOVE LTD in advance of a coaching session, the Coach is not obliged to provide the session.
Where payment is required on receipt of invoice rather than in advance, a charge may be levied for late payment.
7. Scheduling and Cancellations
Sessions are scheduled at mutually agreed times, through the booking links provided using the 'You Can Book Me' platform.
A minimum of 24 hours' notice is required for rescheduling or canceling a session.
Missed sessions without prior notice will not be rescheduled or refunded.
8. Confidentiality
All information shared during the Program is confidential and will not be disclosed to third parties without the Client's consent, except as required by law. However, if you report child abuse, elder abuse, neglect, or threaten to harm yourself or someone else, necessary actions may be taken, and confidentiality may be limited in this capacity.
9. Data Protection and Security
The Coach will protect your information as confidential unless you state otherwise in writing. You understand that the use of technology is not always secure, and you accept the risks of confidentiality in the use of email, Zoom, and any other technology.
10. Intellectual Property
All materials provided during the Program are the intellectual property of the Coach and are for personal use only. Clients shall not distribute, reproduce, or use these materials for commercial purposes without prior written consent.
11. Limitation of Liability
The Coach is not liable for any direct, indirect, incidental, or consequential damages arising from the Client's participation in the Program. The Client acknowledges that coaching is not a substitute for professional medical advice, diagnosis, or treatment.
12. Termination
Either party may terminate this Agreement with written notice if the other party breaches a material term of this Agreement.
13. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
14. Entire Agreement
This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions, agreements, or understandings of any kind.
